Trump’s team seeks to dismiss 2020 election case, criticizes prosecutor
The lawyers of US presidential candidate Donald Trump are trying to wrap up the case of his attempts to change the outcome of the 2020 election, criticizing the prosecutor in charge of the case, reports The Hill.
The former president's lawyers asked the judge to dismiss his case of attempting to influence the election, arguing that Special Counsel Jack Smith was appointed unconstitutionally.
Trump's team took this step in Florida. A motion by Trump's lawyers forced a federal judge to dismiss the indictment. Now Trump hopes for the same luck in Washington.
Trump argues that prosecutor Jack Smith is not constitutionally appointed or funded because he has not been confirmed by the Senate. Trump's lawyers insist that the court should cancel all actions of the special prosecutor, including indictments, and block Smith's office from any further spending.
The prosecutor must respond in writing by October 31, but his team has previously rejected such arguments.
2020 election case
In August 2024, Special Counsel Jack Smith filed a new indictment against former US President Donald Trump for his attempts to prevent the validation of the 2020 presidential election results.
The new version of the document takes into account Trump's partial immunity from prosecution. Trump pleaded not guilty and called the case an attempt to interfere in the election.
